1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning.
2. WINNER RESPONSIBILITIES: Winner will be solely responsible for all costs associated with and procuring (where applicable) all prize-vehicle insurance, gasoline, vehicle maintenance, federal, state and local taxes, and all other fees and expenses associated with the receipt and use of the prize vehicle. Winner must present a valid U.S. driver's license prior to receiving award.
3. ELIGIBILITY: Sweepstakes open only to legal residents of the 50 United States and the District of Columbia, 18 years of age or older as of 4/4/03, with a valid U.S. driver's license. Employees of Sponsors and their respective parents, subsidiaries, affiliated companies, and agents and such persons' household and immediate family members (defined as parent, spouse, child, sibling, or grandparent) are NOT eligible to enter sweepstakes.
4. TIMING: Sweepstakes begins at 12:01 a.m. Pacific Time ("PT") on 4/4/03 and closes for entries at 11:59 p.m. PT on 8/10/03.
5. HOW TO ENTER: Go to www.bfgoodrichtires.com and click on the sweepstakes' link, fully complete the online entry form and transmit as directed. Limit one entry per person/e-mail address. Sponsors may also ask optional questions on entry form, completion of these questions is not required to enter the Sweepstakes.
6. PRIZE: One (1) prize will be awarded, consisting of the following: a) A competition ready, OFF ROAD USE ONLY, tube chassised rock buggy with an approximate retail value ("ARV") of $40,000 (wear and tear, and depreciation due to use and/or display at various events prior to prize delivery have been taken into account to arrive at this value). The prize vehicle is awarded on an "as-is" basis with no warranties regarding its suitability for a particular purpose. THE PRIZE VEHICLE IS FOR OFF-ROAD USE ONLY, IT IS ILLEGAL TO DRIVE THE PRIZE VEHICLE ON ROADS; b) A 2-day/1-night trip for the winner only to the Supercrawl (at time of printing the location of the Supercrawl was not determined, but is tentatively planned for a location in the state of Nevada) for an award presentation on or about 9/26/03 (the "Trip"). The Trip includes: i) Coach-class round-trip airfare for one from a major gateway airport closest to winner's U.S. residence to a major airport near the Supercrawl (winner must leave from and return to the same airport); ii) One-night's lodging; iii) Ground transportation to and from airport and hotel. The ARV of the Trip is $700 (actual value may be less based on location of winner and fares/rates when booked). Sponsors reserve the right, in their sole discretion, to award a cash travel allowance or ground transportation in lieu of air transportation if the winner resides within 300 miles of the Supercrawl location. Trip does not include meals, transfers, gratuities or any other expenses not specifically listed herein. Travel and accommodations subject to availability. If winner cannot travel as described herein and/or cannot be at the Supercrawl for the award presentation as described herein, the Trip portion of the prize will be forfeited and not awarded. Total ARV of the prize is $40,700. Prize is nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsors in the event that a prize cannot be awarded for any reason in which case, Sponsors will award a prize of equal or greater value. Subject to the conditions herein prize will be awarded. All federal, state, and local taxes, fees, and surcharges for prize are the sole responsibility of winner.
7. RANDOM DRAWING: On or about 8/12/03, winner will be selected from all eligible entries received in a random drawing performed by Sponsors, whose decisions on all matters related to this sweepstakes shall be final and binding. Entrant selected as a potential winner must comply with all terms and conditions set forth in these official rules, and winning is contingent upon fulfilling all such requirements. Odds of winning depend on the total number of eligible entries received.
8. NOTIFICATION: Potential winner will be contacted by mail within four days of drawing, and will be provided with a telephone number that potential winner must call within 24 hours of receipt of prize notification, to confirm eligibility and availability for Trip (the "Confirmation Call"). In addition, within five (5) days of postmark of prize notification (the "Reply Deadline"), the potential winner must correctly complete, execute, and return (as directed) via overnight delivery an Affidavit, Waiver, Release, and Indemnity Agreement, and where lawful, a Publicity Release (additional documents may be required at discretion of Sponsors). Failure to comply with the above-mentioned Reply Deadline, or Confirmation Call (or the return of a prize or prize notification as non-deliverable) may result in disqualification and in the forfeiture of any right to the prize, in which case the prize will be awarded to an alternate by random drawing.
9. IMPROPER CONDUCT: If for any reason this sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other cause beyond the control of Sponsors that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the sweepstakes, Sponsors reserve the right in their sole discretion to, disqualify any individual who tampers with the entry process, require the return of any prize or its value, and to cancel, terminate, modify or suspend the sweepstakes, in which case, winner will be determined from the entries received prior to cancellation, termination, modification or suspension.
10. E-MAIL ADDRESS: Computer entries will be deemed to have been submitted by the authorized account holder of the submitted e-mail address at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the winning entry.
11. RELEASE: BY PARTICIPATING IN THIS SWEEPSTAKES AND/OR ACCEPTING A PRIZE, A PARTICIPANT/WINNER AGREES THAT THE SPONSORS, THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSORS' OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY PARTICIPANT/WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY. By participating in this sweepstakes and/or accepting a prize, a participant/winner consents to and gives the Sponsors the right in perpetuity to use winner's/participant's name, city and State of residence, picture/portrait, likeness, voice, statements, submitted descriptive information (in whole or in part, as may be adapted, edited, or modified, as solely determined by Sponsors) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without additional consideration, unless prohibited by law. Sponsors shall have the right to use, assign, edit, modify or dispose of an entry however they see fit without the approval of participant/winner.
12. COMPUTER: Participants agree that by submitting their entries they release Sponsors, and their respective agents from any liability in connection with any error, omission, interruption, deletion, defect, delay, misdirection, or technical malfunctions or traffic congestion on the Internet/telephone network, or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer/software related or resulting from participation or downloading any material in this sweepstakes. Sponsors and participating promotional companies are not in any way liable for damage, loss or injury resulting from computer malfunctions.
13. ERRORS: Sponsors are not responsible for lost, late, illegible, damaged, incomplete, stolen, postage due or misdirected entries, typographical or other human or technical errors in the offer or administration of this sweepstakes, including but no limited to errors in advertising, the Official Rules, the selection and announcement of the winners or the distribution of the prize. Sponsors reserve the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the sweepstakes. In the event that the sweepstakes is challenged by any legal or regulatory authority, Sponsors reserve the right without notice to discontinue or modify the sweepstakes, or to without notice disqualify participants residing in the affected geographic areas. In such event, Sponsors shall have no liability to any entrants who are disqualified due to such an action.
14. LAWS: Subject to all federal, state and local laws and regulations. Void where prohibited.
15. WINNER LIST: A winner list will be available from about 9/1/03 to 10/31/03 by sending a self-addressed stamped envelope to: 4-Wheel & Off-Road/BFGoodrich® Tires Project "Karnivore" Sweepstakes Winner List, P.O. Box 459, Dana Point, CA 92629-0459.
